The Healthcare & Risk Management Practice Section aims to provide precise and timely legal service to healthcare providers and institutions. Whether large corporate conglomerates or neighborhood physicians, healthcare providers need competent legal advice. Nearly every aspect of patient care raises the specter of legal liability. Moreover, revolutionary changes in the delivery of healthcare, new legislation at both state and federal levels, and the demands of insurance companies have disrupted age-old patterns of medical practice. Indeed, healthcare is a dramatically dynamic universe. Kirton & McConkie's Healthcare & Risk Management Practice Section is uniquely poised to provide the array of services needed.
Schooled by years of experience, the section's attorneys offer dependable advice, consultation and representation in a wide variety of matters, including medical staff issues, healthcare-related legislation and lobbying, risk management and quality assurance (including liability issues), corporate and financial issues, Medicare/Medicaid representation, bylaws and contracts, personnel, workers' compensation, bioethical legal issues, antitrust, consent policies and procedures, death and dying, taxation, and emergency medicine.
Section members have extensive trial experience in state and federal courts. Members have also participated in numerous mediation and arbitration proceedings and routinely consult clients regarding corporate and other business matters. Further, we have successfully guided the enactment of healthcare-related legislation favorable to clients. We are in constant communication with other legal specialists in the firm, including those with transactional and regulatory experience, and we work closely with clients to assure optimal results.

Kirton & McConkie's Healthcare & Risk Management Practice Section handle medical malpractice defense litigation and risk management matters for Intermountain healthcare, Inc. (a system of more than twenty hospitals), having represented such regional healthcare facilities as LDS Hospital, Cottonwood Regional Medical Center, and Primary Children's Medical Center in Salt Lake City, Utah Valley Regional Medical Center in Provo, Logan Regional Hospital in Logan, Valley View Medical Center in Cedar City, Dixie Medical Center in St. George, and McKay-Dee Hospital Center in Ogden, as well as many other smaller general and specialty hospitals. Such litigation often includes defending individual doctors associated with the hospitals represented. The section also represents Heritage Management, Inc., and its affiliated care centers, rehabilitation centers, and other healthcare facilities. Kirton & McConkie serves as local counsel to the American Psychiatric Association in defending medical malpractice actions against its members, and Scottsdale Insurance Company in providing medical malpractice defense for anesthesiologists within the state of Utah. Section members also represent the Risk Management Division of The Church of Jesus Christ of Latter-day Saints in litigation throughout the world.
