Overview

Kirton McConkie attorneys routinely handle issues for the construction industry, from simple disputes to complex litigation. We represent project owners, general contractors, subcontractors, engineers, architects, design professionals, suppliers, sureties, governmental entities, and construction lenders.

Our attorneys are well-versed in handling construction-related disputes, such as mechanics liens and bond claims, construction defect and scheduling claims, design professional liability, surety defense and indemnification, and government contracts and claims. Dispute resolution may go beyond the courtroom to panels, mediation, or arbitration where our attorneys have a depth of experience in informal resolution proceedings.

In addition to their legal training, our construction litigation attorneys hold technical degrees in civil engineering and have real-world construction experience allowing them to give cost effective and practical solutions. Our technical knowledge enables us to communicate industry-specific information to judges, juries, and decision makers in meaningful and understandable ways.

One notable case was Northview Christian Church, Inc. v. E & D Company PLLC et al. Kirton McConkie successfully had its clients (six design professional companies involved in the design of a large concrete dome church in Dothan, Alabama) transferred out of a larger action in Dallas, Texas, to their home state of Idaho. Following transfer of the case, Kirton McConkie obtained a successful matter resolution.
